By accessing the website at ridgetopexcavatingllc.com, submitting a quote request, or engaging Ridge Top Excavating LLC ("Company," "we," "us," or "our") for any services, you ("Client," "you," or "your") acknowledge that you have read, understood, and agree to be bound by these Terms and Conditions in their entirety. If you do not agree with any part of these Terms, you must not use our website or engage our services.
Ridge Top Excavating LLC is a heavy civil construction contractor providing the following services in Pennsylvania and the surrounding Tri-State Region:
All services are subject to a separate written contract executed between the Company and the Client prior to commencement of work. These Terms and Conditions are incorporated by reference into any such contract.
All quotes, estimates, and written proposals provided by Ridge Top Excavating LLC are non-binding and subject to change until a formal written contract is signed by both parties. Estimates are based on information available at the time of the site visit or project review and may be revised if site conditions, material costs, or project scope differ from initial assessments. Quotes are valid for thirty (30) days from the date of issuance unless otherwise stated in writing.
No work will commence without a fully executed written contract. Verbal agreements, email confirmations, and informal communications do not constitute a binding contract for construction services. The written contract will specify the scope of work, project schedule, payment milestones, and any special conditions applicable to the project.
Unless otherwise specified in the written project contract, the following payment terms apply to all engagements:
Any modification, addition, or deletion to the agreed project scope must be documented in a written change order signed by authorized representatives of both the Company and the Client before the changed work is performed. Verbal change orders, text messages, and informal email requests are not binding on the Company. The Company reserves the right to stop work if a change order is requested but not formally executed, and no delay damages shall accrue to the Client during such a work stoppage.
The Client is solely responsible for the following prior to and during the project:
The Company shall not be liable for delays, additional costs, or damage resulting from inaccurate or incomplete information provided by the Client.
Unless expressly stated otherwise in the written project contract, the Client is responsible for obtaining all necessary permits, approvals, and regulatory authorizations required for the project, including but not limited to building permits, grading permits, erosion and sedimentation control permits, and environmental approvals. The Company will cooperate with permit applications as reasonably requested and will perform all work in accordance with applicable federal, state, and local regulations, including OSHA safety standards and Pennsylvania Department of Environmental Protection (DEP) requirements.
Ridge Top Excavating LLC warrants that all work will be performed in a professional and workmanlike manner consistent with industry standards for heavy civil construction in Pennsylvania. This warranty does not cover damage caused by Acts of God, extreme weather events, Client modifications to completed work, third-party interference, or conditions that were not disclosed to the Company prior to project commencement. Any warranty claims must be submitted in writing within one (1) year of project completion.
To the maximum extent permitted by applicable law, the Company's total aggregate liability to the Client for any claim arising out of or related to services performed under any contract shall not exceed the total amount paid by the Client for the specific services giving rise to the claim. The Company shall not be liable for any indirect, incidental, special, punitive, or consequential damages, including but not limited to loss of profits, loss of business opportunity, or loss of use, even if the Company has been advised of the possibility of such damages.
Ridge Top Excavating LLC maintains the following insurance coverage as required by Pennsylvania law and industry standards:
Certificates of Insurance are available upon written request and will be provided prior to project commencement. The Client may be named as an additional insured on the general liability policy as required by the project contract.
Ridge Top Excavating LLC maintains an active safety program and is committed to an EMR (Experience Modification Rate) below the industry average. All personnel are trained in OSHA safety standards. The Client agrees to maintain a safe environment at the project site and to immediately report any unsafe conditions to the Company's project supervisor. Unauthorized personnel, including Client employees and visitors, must not enter active work zones without prior authorization and appropriate personal protective equipment (PPE).

Neither party shall be liable for delays or failure to perform obligations under any contract resulting from causes beyond their reasonable control, including but not limited to Acts of God, extreme weather, fire, flood, earthquake, labor disputes, government actions, supply chain disruptions, or other events that could not have been anticipated or prevented with reasonable diligence. The affected party must provide written notice of the force majeure event within five (5) business days of its occurrence.
These Terms and Conditions, and any contract between Ridge Top Excavating LLC and the Client, are governed by and construed in accordance with the laws of the Commonwealth of Pennsylvania, without regard to its conflict of law provisions. Any dispute arising from these Terms or any related contract shall first be subject to good-faith negotiation between the parties. If negotiation fails, disputes shall be resolved through binding arbitration administered by the American Arbitration Association under its Construction Industry Arbitration Rules, with the arbitration to take place in Allegheny County, Pennsylvania. Notwithstanding the foregoing, either party may seek injunctive or other equitable relief in any court of competent jurisdiction.
If any provision of these Terms and Conditions is found to be invalid, illegal, or unenforceable by a court of competent jurisdiction, the remaining provisions shall continue in full force and effect. The invalid provision shall be modified to the minimum extent necessary to make it enforceable.
These Terms and Conditions, together with any written project contract and the Privacy Policy, constitute the entire agreement between Ridge Top Excavating LLC and the Client with respect to the subject matter herein and supersede all prior and contemporaneous understandings, agreements, representations, and warranties, whether written or oral.
Ridge Top Excavating LLC reserves the right to modify these Terms and Conditions at any time. Updated Terms will be posted on this page with a revised "Last Updated" date. Your continued use of this website or engagement of our services after any such changes constitutes your acceptance of the revised Terms. We encourage you to review these Terms periodically.
